1. Acceptance of Terms
Welcome to Optima AI (“Optima”, “we”, “us”). By accessing or using our website www.optima.onl and any related products or services (collectively, the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Service.
2. Description of Service
Optima provides an AI-powered platform that assists with e-commerce operations, including conversational AI, product research, content generation, automated workflows, and related browser-extension tools. Features and availability may change at any time without prior notice.
3. Account Registration
- You must provide accurate, current, and complete information when registering, and you are responsible for all activity under your account.
- You must safeguard your account credentials and notify us promptly of any unauthorized use.
- Each user is limited to one account. Impersonation, resale, or unauthorized sharing of accounts may result in suspension or termination.
4. Acceptable Use
When using the Service, you agree not to:
- violate any applicable law, regulation, or third-party right;
- upload or transmit malicious code, viruses, or other harmful software;
- reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service;
- access, interfere with, or disrupt any part of the Service without authorization;
- use the Service for spam, fraud, harassment, or other abusive activity;
- use the Service for any activity that violates commercial-compliance requirements.
5. Subscription and Billing
- Certain features require a paid subscription. Pricing, billing cycles, and included features are described on the subscription page.
- Subscriptions automatically renew at the end of each billing cycle unless cancelled in advance.
- All fees are charged in the currency shown at checkout and may include applicable taxes.
- Payments are processed by our third-party payment providers; their terms apply in addition to ours.
6. Refunds
Our refund terms are described in our Refund & Cancellation Policy, which forms part of these Terms.
7. Intellectual Property
- The Service and all of its content, features, trademarks, logos, and design are owned by Optima or its licensors.
- You retain ownership of any content you upload to the Service (“User Content”). You grant Optima a non-exclusive, worldwide, royalty-free license to operate, improve, and provide the Service.
- Content generated by AI models based on your input (“Generated Content”) belongs to you to the extent permitted by applicable law. You are responsible for the lawful use of Generated Content.
8. AI-Generated Content Disclaimer
AI models may produce outputs that are inaccurate, incomplete, or biased. Optima does not warrant the truthfulness, accuracy, or fitness of Generated Content for any particular purpose. Verify outputs independently before relying on them for important decisions.
9. Privacy
Our handling of personal information is described in our Privacy Policy. By using the Service, you consent to that processing.
10. Modification and Termination
- We may modify, suspend, or terminate any part of the Service at any time without prior notice.
- We may suspend or terminate your access if you breach these Terms.
- You may stop using the Service at any time and cancel your subscription in accordance with Section 5 and the Refund Policy.
11. Disclaimer of Warranties
The Service is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, Optima disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Optima and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability to you, regardless of the legal theory, shall not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China. Any dispute arising from or relating to these Terms or the Service shall first be resolved by friendly negotiation; failing that, it shall be submitted to the Hong Kong International Arbitration Centre for arbitration under its rules then in force.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-Service notice. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
